Introduction

Welcome to Aegis Vitalis. These Terms of Service ("Terms") govern your access to and use of our chronic disease monitoring and preventive healthcare platform, including our website, mobile applications, patient portal, and all related services. By creating an account or using any part of our Services, you agree to these Terms in their entirety.

We encourage you to read these Terms carefully and contact us at legal@aegisvitalis.pk if you have any questions before using our Services.

Important Medical Notice

Aegis Vitalis is a health monitoring and prevention platform. Our Services are not a substitute for professional medical advice, diagnosis, or treatment. In case of a medical emergency, please call 1122 or visit your nearest emergency room immediately.

Agreement to Terms

By accessing or using the Aegis Vitalis platform, website, mobile applications, and related healthcare services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use our Services.

Binding Agreement

These Terms constitute a legally binding agreement between you ("User," "Patient," or "you") and Aegis Vitalis ("Company," "we," "our," or "us"), a healthcare technology company registered in Lahore, Pakistan. Your continued use of the Services after any modifications to these Terms constitutes acceptance of the revised terms.

Additional Agreements

Certain features or services may be subject to additional terms, guidelines, or policies. Such additional terms are incorporated by reference into these Terms of Service. In the event of a conflict, the additional terms shall govern with respect to the specific feature or service.

Age Requirements

You must be at least 18 years of age to create an account and use our Services independently. Individuals under 18 may use the Services only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on their behalf.

Account Registration

To access certain features, you must register for an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

Account Accuracy

You agree to provide truthful and accurate health information, personal details, and medical history. Providing false or misleading information may result in inaccurate health assessments and could compromise the quality of care you receive. We reserve the right to suspend accounts with fraudulent information.

Healthcare Monitoring

Aegis Vitalis provides chronic disease prevention and monitoring services, including but not limited to: vital signs tracking, blood glucose monitoring, blood pressure management, health risk assessments, lab result analysis, and personalized health recommendations through our digital platform.

Subscription Plans

Our Services are offered through various subscription tiers (Basic, Classic, Standard, Premium, and Platinum), each providing different levels of monitoring, consultations, and health management features. Plan details, pricing, and included features are described on our Pricing page and may be updated periodically.

Service Availability

While we strive to maintain uninterrupted access to our Services, we do not guarantee that the platform will be available at all times. We may temporarily suspend access for maintenance, updates, or circumstances beyond our control without prior notice.

Not a Substitute for Medical Advice

The information, health assessments, and recommendations provided through Aegis Vitalis are intended for informational and monitoring purposes only. Our Services do not constitute medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified healthcare provider with any questions regarding a medical condition.

Emergency Situations

Our Services are not designed for medical emergencies. If you are experiencing a medical emergency, call your local emergency services (1122 in Pakistan) immediately. Do not rely on the Aegis Vitalis platform for emergency medical assistance.

Professional Medical Relationship

Use of our platform does not create a traditional doctor-patient relationship. While our medical team provides guidance and monitoring, you should maintain regular visits with your primary healthcare provider for comprehensive medical care.

Health Data Accuracy

The accuracy of health insights depends on the quality and completeness of data you provide. We are not liable for any health decisions made based on incomplete or inaccurate data entered into the platform.

Responsible Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not use the platform to transmit harmful, offensive, or illegal content, or to interfere with the proper functioning of the Services.

Data Integrity

You are responsible for the accuracy of health data you submit, including vital signs, medication information, and medical history. Intentionally submitting false health data may compromise your care and violate these Terms.

Prohibited Activities

You shall not: (a) attempt to gain unauthorized access to other accounts or systems; (b) use automated tools to scrape or collect data; (c) reverse engineer or decompile any part of the platform; (d) share your account credentials with third parties; (e) use the Services for any commercial purpose without authorization.

Compliance with Laws

You agree to comply with all applicable local, national, and international laws and regulations when using our Services, including healthcare regulations and data protection laws applicable in Pakistan.

Subscription Fees

Access to our Services requires payment of subscription fees as outlined on our Pricing page. All prices are listed in Pakistani Rupees (PKR) and are subject to applicable taxes. We reserve the right to modify pricing with 30 days advance notice to existing subscribers.

Billing Cycle

Subscriptions are billed on a monthly recurring basis unless otherwise specified. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. Payment is due at the beginning of each billing period.

Refund Policy

Refund requests must be submitted within 7 days of the billing date. Refunds are evaluated on a case-by-case basis. No refunds will be issued for partially used billing periods. If we terminate your account due to a violation of these Terms, no refund will be provided.

Plan Changes

You may upgrade or downgrade your subscription plan at any time. Upgrades take effect immediately with prorated charges. Downgrades take effect at the start of the next billing cycle. Any unused features from a higher plan will not carry over.

Ownership

All content, features, functionality, software, designs, text, graphics, logos, and trademarks on the Aegis Vitalis platform are owned by or licensed to us and are protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding without prior written consent.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial healthcare management purposes, subject to these Terms.

User Content

You retain ownership of health data and personal information you submit. By using our Services, you grant us a limited license to use, process, and store your data solely for the purpose of providing and improving our healthcare services, as described in our Privacy Policy.

Privacy Policy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal and health information. By using our Services, you consent to the data practices described in our Privacy Policy.

Data Security

We implement industry-standard security measures including encryption, access controls, and regular security audits to protect your data. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

Health Data Handling

Your health data is treated with the highest level of confidentiality in compliance with applicable healthcare data protection regulations. We will never sell your personal health information to third parties for marketing or advertising purposes.

Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Damages

To the maximum extent permitted by law, Aegis Vitalis shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or health outcomes, arising from your use of or inability to use the Services.

Maximum Liability

Our total liability for any claims arising from or related to these Terms or the Services shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim. This limitation applies regardless of the theory of liability.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, power outages, or internet service disruptions.

Termination by You

You may terminate your account at any time by contacting our support team or through your account settings. Upon termination, your access to the Services will cease, and your data will be handled in accordance with our Privacy Policy and applicable retention laws.

Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. We may also terminate accounts that remain inactive for an extended period.

Effect of Termination

Upon termination, your right to use the Services immediately ceases. Sections of these Terms that by their nature should survive termination shall continue in effect, including intellectual property provisions, disclaimers, limitations of liability, and dispute resolution.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to conflict of law principles. Any legal proceedings shall be conducted in the courts of Lahore, Punjab, Pakistan.

Informal Resolution

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at legal@aegisvitalis.pk. We will attempt to resolve the dispute through good-faith negotiation within 30 days.

Arbitration

If informal resolution is unsuccessful, any dispute shall be resolved through binding arbitration in accordance with the Arbitration Act of Pakistan. The arbitration shall be conducted in Lahore by a single arbitrator mutually agreed upon by both parties.

Right to Modify

We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. Material changes will be communicated via email or a prominent notice on our platform at least 30 days before they take effect.

Continued Use

Your continued use of the Services after any changes to these Terms constitutes your acceptance of the new terms. If you do not agree to the modified terms, you must discontinue use of the Services and terminate your account.

Version History

We maintain a record of previous versions of these Terms. You may request access to prior versions by contacting our support team. The current version always supersedes all previous versions.
